Non-compliant driver qualification files can result in gross negligence jury awards

Driver qualification files (DQF) are one of the first items that are reviewed in a DOT compliance audit. They are also one of the first items requested by plaintiff attorneys in a civil lawsuit.

Non-compliant files can expose a carrier to civil penalties in an audit and exorbitant jury awards for gross negligence for negligent hiring and/or retention in lawsuits. It’s not uncommon for these jury awards to be tens to hundreds of million dollars. In most cases, these are not insurable losses leaving the carrier responsible.
